Grand jury indicts Wasilla man accused of raping sleeping teen

PALMER -- A Palmer grand jury on Wednesday indicted a Wasilla man who allegedly had sex with a sleeping 15-year-old girl four months ago.

William Quill, 29, was charged in June with second-degree sexual assault and second-degree sexual assault of a minor in June. He has been lodged in the Mat-Su Pre-Trial Facility since then.

According to the indictment, Quill engaged in sex June 14 with a 15-year-old girl who was "incapacitated or unaware that a sexual act was being committed."

Quill was cleared of rape charges two years ago by a Palmer jury. In that case, he was charged for allegedly sexually assaulting an 18-year-old girl. The circumstances surrounding the two cases are very similar, according to Alaska State Troopers who investigated both cases.

Quill, was arrested and charged June 15 after troopers received a complaint that morning from a man who said he was the teen-ager's uncle.

The alleged victim's uncle, who said Quill was a friend, told troopers Quill had come to his home at 4:30 a.m. When the man awoke at around 7 a.m. he found Quill in his niece's bed, lying on top of the sleeping girl, according to court records.

He told troopers Quill jumped up and pulled up his pants when he realized the uncle had entered the room, according to court records.

The girl told troopers she found Quill in bed with her and her underpants pulled down after her uncle awakened her that morning. The 15-year-old told troopers she had not consented to having sex with Quill.

The teen said she was a heavy sleeper and wasn't sure if Quill had sexually penetrated her. However, she said she later found physical signs that indicated sexual intercourse had occurred.

During the investigation, Quill told troopers he did not remember anything, but he knew the teen did not live at her uncle's home.

At 10:30 a.m., troopers administered a Data Master breath test to Quill, and the results reportedly revealed Quill had an alcohol level of .121. In Alaska, a person with a blood-alcohol level of .08 or above is considered legally intoxicated.

Quill is on felony probation until June 2003 for a dangerous drug conviction, according to court records. As part of the condition of his probation, Quill is not allowed to drink or enter any premises where alcohol is sold. He was also ordered to submit to a urinalysis or blood alcohol screening at the request of his probation officer.

In September 1999, Quill was tried on charges of fourth-degree misconduct involving a controlled substance and first-degree sexual assault, after his 18-year-old female roommate claimed Quill raped her in her bedroom, where she was sleeping. The jury acquitted him of the sexual assault charge, but convicted him of the drug charge.

In charging documents for the latest case, Trooper Sgt. Dennis Ponder said there were certain similarities in the two cases, including Quill's level of intoxication, the fact that he reportedly engaged in sexual penetration with each of the teen-agers and that both the 15-year-old and Quill's roommate were asleep at the time of the alleged incidents.

Troopers also pointed out that in each of the cases, Quill said he had no memory of what happened.

In the 1999 case, Quill had apparently returned home from a night at a local strip club where he had been drinking and paid $40 for a "lap dance," according to court documents. Quill's roommate claimed he entered her bedroom where she was sleeping and attacked her.

When troopers arrived after being called to the residence, they found Quill passed out. He told investigators he didn't remember the events his roommate alleged had happened.
