Lawyers should seek justice, not to ‘win’

Justice in the USA? What about root causes?

We talk about “the system.” We have a very good system. It breaks down with lawyers out to win instead of using the law appropriately to defend or prosecute. Lawyers are not allowed to lie, make false charges and insinuate things that are not true, a real spin to “win” his or her side of the argument.

This is where justice is corrupted. It is not often with the judge, the system or the jury. Not very often, anyway. No lawyer should ever be patted on the back for “winning.” It is not the way to calibrate the quality or ability of lawyer.

I suggest defense and prosecuting attorneys be sworn in at every court hearing. After all, they represent the sworn-in defendants and/or justice. Each should be held accountable for false statements (perjury) with penalties equal to the defendants’ possible penalties, loss of income from that case and loss of a license for three acts of perjury. The public and the justice system should demand this immediately, not in years to come.

I also suggest salaries based on the work needed to prove a case one way or the other, but that lawyers not be allowed to pad their charges similar to many service industries.

A defendant is guilty if and when he/she commits a crime, and at that time. It is the law that cannot proclaim one guilty until proven in court. The public should also refrain from judging. We, the public, are not the law and seldom know the law, nor know the many facts to be brought out in court.

The courts are much more likely to hear the truth if lawyers are highly penalized for corrupting facts about their cases in order to win. We need a whole new criteria for the egos of attorneys, such as judicial knowledge of law books and eliminating false charges (both sides).

Why aren’t attorneys required and/or trained to be more like investigative reporters? At least any defendant with a possible penalty of more than five years should be required to have his/her case handled by an investigative reporter. This should be part of any serious offense.

Let’s hear court cases based on law, not attorney theatrics. After all, a corrupt attorney fails the public as badly as corrupt public officials.
