Man arrested for DUI, sex abuse

PALMER — A man who was previously arrested on charges of second-degree sexual abuse of a minor now faces 10 similar counts, court records show.

Troopers arrested Allen Kenneth Theodore, 54, for a string of alleged sex abuse crimes in multiple communities over more than a decade.

Theodore was originally arrested June 10 and charged with felony driving under the influence.

But while in custody on $10,000 cash or corporate bail, Alaska State Troopers also charged him with nine counts of second-degree sexual abuse of a minor, a single count of third-degree sexual abuse of a minor, one count of rape, and one count of third-degree assault, according to an indictment filed July 2 in Palmer Superior Court.

Theodore faced a single count of second-degree sexual abuse of a minor in 2005, a charge that was amended to contributing to the delinquency of a minor, court records show.

The indictment identifies a single, repeated victim by initials, gender, and date of birth. Based on that information, the female victim could have been as young as 13 when the abuse began in Kenai, and 17 for the most recent counts, which are in Wasilla.

The Frontiersman does not identify victims of sex crimes.

Theodore’s brush with the court system started in 1984. Detailed court records from that era weren’t available online, due to the recent computerization of older files.

When police charged Theodore in 2005, second-degree sexual abuse of a minor was a class A misdemeanor, according to court records. Legislation passed in the years since has increased penalties for sex crimes against children, and the second-degree sex crimes — involving penetration — Theodore faces are now class B felonies, punishable by up to 10 years imprisonment for each count. The third-degree sex crime and third-degree assault are class C felonies with a five-year maximum sentence.

Rape is an unclassified felony in Alaska, carrying a potential sentence ranging from 20 to 99 years upon conviction. Theodore faces a maximum sentence of 204 years.

Allen remained in Goose Creek Correctional Center Monday afternoon on the $10,000 bail with a court-appointed third-party custody requirement for driving under the influence. And he was also held in the sex abuse case on a $50,000 cash-only bail, also with a court-appointed third-party requirement.
