Miller loses Alaska Supreme Court fight

A ruling today by the Alaska Supreme Court clears the way for the State Division of Elections to certify results from the Nov. 2 U.S. Senate race.

Wednesday afternoon the Alaska Supreme Court ruled against U.S. Senate candidate Joe Miller on all counts.

“We start with the bedrock principle that “[t]he right of the citizen[s] to cast [their] ballot[s] and thus participate in the selection of those who control [their] government is one of the fundamental prerogatives of citizenship,” justices ruled. “The right to vote “is fundamental to our concept of democratic government. [It] encompasses the [voter’s] right to express [the voter’s] opinion and is a way to declare [the voter’s] full membership in the political community.”

The court affirmed the decision of the Alaska Superior Court in all respects.
