PALMER -- Three Palmer men face multiple charges, including first-degree attempted burglary, in connection with an incident at a local business.
Devin Donn, 18, Joshua Henderson, 19, and James Sowinski, 18, are accused of trying to break into the Palmer Radiator shop, 173 S. Valley Way.
Palmer Police Sgt. Tom Remaley and officer Peter Steen saw the three "kicking and beating on the door" at 9:54 p.m. on June 20, according to Steen's report. Sowinski and Donn complied when told to stop, but Henderson ran, according to charging documents filed in Palmer District Court.
Sowinski and Donn were put into a police car, and Henderson soon came back and tried to free them, court documents said. However, Steen's report said Henderson was unable to open the car door.
Henderson ran again but was soon caught and "refused to comment on why they had been kicking the door," the report said.
However, the other two suspects told officers they were trying to wake up a man named "Joe" who lived above the shop. The men said they wanted to purchase a fuel filter, Steen's report said.
The report added, "Sgt. Remaley contacted the defendant's father, the owner of the shop, who stated there was a person named 'Joe' living over the shop, but he had no idea why the defendant and his friends had been at the shop and had not sent them there."
The three men were scheduled to appear for a preliminary hearing on Friday afternoon. First-degree attempted burglary is a Class C felony punishable by up to five years in prison and a fine of not more than $50,000.
Donn faces additional charges of hindering prosecution in the first degree, misconduct involving a controlled substance in the sixth degree, and minor consuming alcohol.
Henderson faces additional charges of tampering with evidence, misconduct involving a controlled substance in the sixth degree, minor consuming alcohol, and several outstanding warrants.
Sowinski faces additional charges of first-degree hindering prosecution, promoting contraband in a correctional facility in the first degree, tampering with evidence, sixth-degree misconduct involving a controlled substance, and minor consuming alcohol.
